Do I have to go to the INS interveiw?

I married a man from the UK in June of 98. I have decided to divorce him based on the fact he does not want children and I do.
We have just received a letter from the INS for an interview. Do I need to attend?
How do I tell the INS I intend to divorce my husband? The anomosity I feel towards him is apparent, and I'm sure the INS would be aware of the troubles in our marriage. I do not want to go to jail, or pay a fine. I just want out of the marriage.
Any advise or help would be appreciated.

Does he want to stay in the US or return to the UK ? Best thing to do is just not attend the interview, he will get no where without you.. since he can not go without you, then the INS will deem the application abandoned. Also, you can write a letter and explain the marriage is over.

He would like to stay in the country. I would hate to see him get deperted. But I can't stay married to a man who doesn't want to have children.

You have to do what you have to do.. otherwise you could be done for fraud. Ever thought he might be doing this just to get out of the marriage ?

Anyway, legally, you should not attend the interview. What else you do as regards to a letter to the INS is up to you..

I'm pretty certain he does not want out of the marriage, but only because he is afraid of deportation. He has told me that if we do not attend the interveiw I could possibly be fined and that I could go to jail and/or be heavilly fined. He says that by not going and by filling for divorce before the interview the INS will suspect a sham marriage. We have not shared any bills and the only proff of shared res, is mail we have received at the same address. I wasn't sure if this were true. I thought it would be worse if we go to the interview and say everything is good when it is not.
Thank you very much for the advise. I think I should get a lawyer, and get divorced asap.
Just one more question...Do I need to go into detail about why the marriage is over in my letter to the INS?
