The way court works is that the the other party will present their evidence and then you will present your evidence. Whatever side has the more compelling evidence will win. If they have photos and you have nothing, then you lose.

It's a civil lawsuit, not a criminal case. There is no "guilt" in a civil case and the phrase "innocent until proven guilty" doesn't apply. But the plaintiff will have to prove his case against you at trial. If you don't show at the trial to defend, though, the plaintiff wins by default.
