I am 17 years old and was calibrated doing 95 mph in a 55 by an unmarked SUV traveling along the highway w/ me on interstate 495. The police officer also told me that I was weaving in and out of traffic and that he was following me for miles. Empty beer cans were found in a bag in the backseat of my car. I was given a sobriety test and passed and was therefore not breathalized. The police officer only charged me for the speeding and did not put anything down for the alcohol situation on my citation. I am scheduled to go to court in a week. Is the police officer allowed to mention the beer cans found in my car even though he did not put it down on my citation? DO I NEED A LAWYER? Any advice would be appreciated greatly.

He certainly could bring up the beers cans, but why would he? You were cited for speeding, not open intoxicants...they have no relevance.

He could have charged you for open container but luckily he didnt so be happy for that, if he brought up the subject in court it would be irrelevant and he probabrally wont. Ask if he has any evidence of following you for miles, ie video tape. also if you want to fight it ask for the reedings on the radar and when the last time it has been collaborated.
 
95/55 - Speeding? No way...it's RECKLESS in VA

95/55 - and you say he charged you ONLY with speeding? Are you serious?

Check your ticket carefully, and you'll see a charge for RECKLESS DRIVING.
See a lawyer ASAP as this CRIMINAL CHARGE has ramifications (like a CRIMINAL RECORD).
