my son is almost 2
I was awarded sole physical and legal custody. I let her visit with the child for 4 weeks and now she wont give him back. She has moved in with a new boyfriend and has not told me where she is, wont answer my calls. She has not registered her new address w/the courts. is a missing child report my only option?

Getting your child back

You can have her charged with "Parental Abduction". We had to do "Missing Child" and we also contacted the passport office. It may be the only way you get your son back. Try to check with the post office for a forwarding address? Also, if you can keep an eye on anyone you think she might visit to see if she comes around. The same thing happened to us only we had to have the authorities involved because they were taken to Mexico.

When you file a police report If you know her birth date SS# anything like that. ask them to run her through the FPLS I believe it's called . It's a system they have to try and locate missing / wanted persons .

You could also ask the Court to initiate and sign for one but that would probably take more time. You need to get the child back ASAP.

By all means you should contact the police and an attorny to file contempt charges on her. I hope you find your child and you will be in my prayers. :D

well, I found my son. :) My mother saw my son and his mother shopping around my town because she was visiting with her mother who also lives in my town. my child's mother told my mom that she would in town for a while so I immediately called her mother's house and she finally talked to me and I told her that she needed to give our son back to me. She refused so I called the police! I only had them keep the peace and enforce the court order. I would like my son to see his mother again but I don't want to risk her running again. Would supervised visits be o.k.?

Supervised visits would be up to the court. If the order does not specify this, then you cannot force the matter. And the police can only enforce what the court order says.

I'm amazed that you have not tried to press charges against her!

My suggestion is that you go back to court immediately and modify the court order specifying the supervised visitation. Given the recent parental abduction, I would say you have a good shot at it ... though without a police investigation of the crime, she is probably going to say that you gave her permission to have the child.
