Depends on your state and what the judge orders.....which is often times what he/she feels for the day and has nothing to do with anything else.
In my case from many, many years ago, I went back to school full-time for my Bachelors after my divorce. A higher education was my way to a better job to support my child as a single mom. I asked the courts for my ex to pay 1/2 the childcare costs while I was in school. I looked at it as regardless of being in school or working - either way - my child needed outside care while I was away from the home. The judge denied having my ex pay for daycare while I was in school, but ordered him to pay it when I worked. To me, this didn't make any sense - either way, I needed childcare - and attending school was like working - I was working at my studies to make a better life for my child - but the judge didn't see it this way.
So, even though I am a woman and can totally see where your ex is coming from on this......working or going to school is all the same (it's not like I was needing childcare to go out to the bars every night), the judge in your case may not approve this just as he didn't for me.
