do we have a case? title company forgery

What is the name of your state? California

My husband and I signed our mortage papers, and title papers with our title company in the beginning of June. The week after we had signed them our bank called us and asked us what day we signed our papers, so we told them, and to make a long story short, the title company either had to change some of the documents, or forgot to have us sign a few pages, so they forged our signatures and date. We have contacted the title company of this, and we have copies of the forged papers from the bank.

The title company offered us a minimal refund check for the time off of work that we missed to go and sign all of the documents a second time to make them legal. We think that this is not enough, and what they did is illegal. Do we have a case to sue them if we hire a lawyer? Any advice would be welcomed!

**A: hire a real estate attorney and go after their license and E&O insurance.

Can you please tell me E & O insurance is? My husband and I are new to all of this and are compltely flabbergasted with everything that happened.

You certainly have a cause of action for fraud, breach of fiduciary duty, and some other things too. The most important question I have is whether it's worth pursuing them for money damages, versus just reporting them to the appropriate licensing authority and letting them deal with it. You don't appear to have suffered much other than inconvenience given how quickly the bank pointed the problem out to you. Litigation is a pain in the butt, so don't enter it lightly. Consult with an attorney before simply assuming you have a lawsuit to pursue.
