What is the name of your state?What is the name of your state?louisiana My husband and his ex wife have joint custody of their two children. We have filed for modification of custody. We went to court on the 8th and the ex-wife showed up with no lawyer. The judge gave her until April the 4th to get counsil. We have taken many pictures of bruises on the children but mainly the little girl. The children have been late to school sometimes as many as three to four days a week. My step-son will have to be retained in the third grade. He can't read at grade level is making zero on spelling tests has mastered none of his multiplication fact etc. He is under the 504 law and has modifications. The mother does
not show up to meetings. My husband and I went to a parent teacher day and the ex -wife came in irrate screaming and cursing in the school that we had no right to be their. The children stay with the mothers parents while she works. The grandfather and uncle both smoke pot and the grandmother has been known to abuse prescription drugs . The children have been moved to nine different homes since the divorce. they have been sleeping on the couch in homes while other people their mother had in the home were using their room. We pay close to 6000.00 per year in child support the children don't even have a bed they are sleeping on a mattress on the floor. Back during July the little girl came to the house with lice. Every weekend for a month I combed and treated her head for lice until finally we got rid of it. We have the teachers of the school coming to court on our side to testify to the mothers behavior and irresponibility. also the grandfather has a record for spending jail time for drugs. do we have a chance of getting custody?

Can you get someone to testify to the drug abuse? Did you get CPS involved when the bruises were noticed? If you were to get CPS involved, they would do a full investigation to determine what is going on. Gather evidence of the children's school records. Get witnesses that can testify to the alleged drug abuse that is occuring in front of the children. Have your attorneys supoena anyone from the children's school to testify that would have knowledge of the mother's character. Also get copies of all the ARD meetings, to prove who was there, etc.... I'm not an attorney, but I've been through all this crap before.
