My wife who is a Mexican National was previously married to a Permanent Resident who was sponsoring her on her paperwork to become a Permenent Resident(USA). She has since divorced that person and is now currently married with me. Question is:

1. Does her paperwork stop automatically and/or how is the INS Office notified that there is a change in the filing.

2. Can I sponsor her now or do we have to wait for INS to stop/clear her first filing.

3. What must she do that will allow her to begin the process again without being in the "system" twice.

Thank you,

1. It is not automatic. Someone needs to tell them.
2. Go to the local INS office with applications in hand and tell them the details.
3. Best advice is to go see an Immigration Attorney. The INS may find her situation very suspious and deport her. An attorney would be my route..
