Here is part of the problem...

An internet forum can give you general information and ideas regarding legal issues. An internet forum cannot give you absolutes.

You don't trust the state to set child support correctly, but you are trying to insist that anonymous strangers, on an internet forum, give you specific, concrete answers to questions that cannot be answered as specifically and concretely as you would like on an internet forum.

We have told you what we can. If you want more than that, then you need to hire an attorney.

You know, you're right, i haven't said thank you yet to you guys! You have no idea how helpful you've been in crafting my argument for court! I now have a basic idea of what i will be going up against, how NY may want to calculate medical separate from CS. It gives me a much much better idea as to how i want to 'word' the order i draft for the judge.

So thank you guys again!!
 
I have an attorney, obviously any order will be written with his assistance and reviewed/edited several times by both him and I before going before the court

A side note:


What If the Parties Disagree with the Support Magistrate's Order?

Both parties have the right to appeal the order by filing an "objection" within 30 days
of the date the order is sent to them. The objection must be filed with the court clerk's office,
with a copy sent to the other party. The other party may send a reply to the court. After review
ing
the case file, a judge then rules on the objection. The judge may leave the order as it is,
change it, or send the case back to the Support Magistrate for further proceedings.
If either party disagrees with the judge's decision, the case may be appealed to a higher court

And that's the other problem. You're essentially asking us to second guess your attorney - and that's something none of us are comfortable with.

You don't think it's better to make sure the problem doesn't happen in the first place, by giving the judge a well written and correct order, instead of having to go back through the process several times to correct mistakes?

Now I know that when i write the order i need to specify something like this:

Father shall maintain a policy of health insurance for the benefit of the child, provided that it is available to him at a reasonable cost through his Employer. Mother shall pay the first $500.00 of uncovered medical expenses for the child, including co-pays and deductibles. The parties shall equally divide all uncovered extraordinary medical, dental, orthodontia, eye care, prescription drugs, glasses, psychological or other health care expenses for the minor child beyond that $500. Receipts for medical care must be submited to the other parent within 30 days and paid within 30 days.

instead of deducting from base child support for it and i really do thank you guys for that! It's going to be a pain to get her mom to pay, but maybe a few contempt cases will fix that.
