What is the name of your state?ny--------sorry to bother you guys again but i have some questions......i hurt my back in december at work been out on comp.last friday i went to doctors and asked him to let me go back to work basically because i was tired of work calling me and harrassing me about coming back...well he said ok as long as if i have any pain to come right back in to see him...so i went back to work monday i was there for only three hours and my back was bothering me so much that i called doctor and he took me back out of work..now my work keeps calling me yelling saying i had no reason to go back to doctor and that my doctor shouldnt have taken me out again..i told them that i was sorry,and atleast i tried...now comp is giving me crap.....i was just wondering what my options are..i feel like im being punished for this...im getting to the point where i cant handle the stress..trust me if i could handle the pain and discomfort i would be working...is this common..to be harrassed by employers and comp?

Not sure about NY laws but as long as your work comp doctor tells you, you can't work and gives you a doctors note to give to your work,they can't make you come back against doctors orders

Welcome to the world of Workers Comp. GET A LAWYER!!!!!!!!!!! I have been out of work on a worker related injury, had 3 surgeries so far and today the doctor ordered another surgery. I am seeing a shrink because of all the stress and on meds to sleep and function. Then to top it off I was Let Go because I wasn't able to perform my job duties. Thats the thanks you can get for getting injured making someone else rich. Workers comp insurance companies are a nightmare in themselves. They will break you down to the point of no return. However, your employer should not be calling you and harrassing you, that is against the law. Let them deal with a lawyer and let the lawyer deal with them. In ny, where I am from also, lawyers fees come out of w/c settlements, not directly from you. Be prepared for the long haul and good luck. Still waiting after 1 1/2 years.
