What is the name of your state?ny i hurt my back at work in dec.i have been out on comp since...just started pt..comp inurace sent me to independant doctor for an second opinion..i guess he said i can go back to work on light duty lifting no more than 5 pounds...work sent me a letter that said i have to return back to work on lightduty sweeping the floors...went to see my doctor and he says no way he doesnt want me back to work until i finish pt at the earliest...so i listened to my doctor and now i got a letter saying my benefits were suspended because i failed to return to work...and now to top everything off i get another letter from work saying i was fired for not returning to work...i also have been seeing a surgin and he says not to return to work until after pt because i may need surgery...i really dont know what to do now i have no income no job and i have three kids to support...is there anything i can do..i feel like im being punished for getting hurt doing my job and listening to my doctors....any advice would be a great help..thanks ps..sorry for bad spelling

If your doctor told you not to return to work did he give you a doctor's note?
If he did, did you give it to your human resources office?
Also dod you talk to your work comp case manager?
Answer yourself these questions first..And when your doctor told you not to return to lightduty did you talk to your boss and HR office?

Which doctor told you that you could not return to work? Your own personal physician or the authorized treating physician?

the doctor that told me to stay out of work is the doctor thart has been seeing me since i hurt my back...the doctor that says to go back is the independant doctor...

You have not answered the question I posed, which will make a difference in how your question can be answered. I understand the doctor who told you not to go back to work is the doctor who has been treating you since the injury; however, what is unclear is whether or not this is the authorized treating physician. What I mean by authorized - is work comp provided this doctor to treat your injury. If the doctor who told you not to return to work is the authorized treating physician, then you are under no obligation to adhere to the advice of the independent physician. Now, if the doctor you are seeing is a doctor you chose, then that changes everything. It appears that your best option would be (1) if your treating doctor was chosen by work comp - stick with him; (2) if not, ask for a panel of four - which should provide you with a list of four doctors you can chose for treatment.

There are a lot of different avenues you can take but until I know for certain if the doctor who has been treating you is authorized, there is really no point in trying to figure it out. Sorry - need specific details.
