Drug Testing for Step parents

My ex wife has remarried and I've suspected that the step dad smokes pot. Is there any legal action I can take to get him tested. If so how? If he is found to be using drugs can I have my son removed from the home to live with me? I know my ex wife doesn't use drugs and she would willingly be tested. To give some back ground I was divorced in Jan. 2000 I'll admit I wasn't the model father either. I used drugs and have since exhonorated my self by a hair folicle analysis order by the judge in 2004. In doing this I have regained some of my visitation rights to my son. Any advice or information on this would be appreciated.

No court is going to order a drug test unless you have proof that it's warranted. Saying you "suspect" he spokes weed w/o anything to back it up ain't gonna cut it.

What does your son have to say about this? How old is he? If he has seen his step-father smoke weed with his own eyes, that might be enough to get the step-father tested.
