i got pulled over for no reason at all. i tried to be very nice. i told the cop that i had a few beers and that i was able to drive. he searched my car and gave me a feild sobriety test. i passed it and was about to drive home when another cop pulled up and asked if i was drunk. the original officer said that he was going to let me go. then the new cop waved his pen infront of my face, a test that i had already passed along with the rest of a full field test, and the new cop then declaired me drunk. i was arrested and taken to jail. on the way home the cop told me that if i did not blow for the breathilizer my licence would be gone for a year rather than 3 months. i blew over the limit. can i still fight this??

Basically, know this: your license gets suspended automatically upon arrest.

There are ways to dismiss the charge based on these two tests, etc but as to which one test carries more weight, I am unsure. You need to get a criminal defense attorney in your state to help you from arraignment on because basically, you might wind up getting into a lot more trouble without one.

If you blew over the limit on a breathalyzer test then I really am unsure as to what you would want to fight. The judge is going to look at the results of the widely accepted breathalyzer test, see that you were legally over the limit, and then subject you to whatever the penalty is for the state of Utah.

What exactly is it that you want to fight?
