What is the name of your state? Penn.
i was just sentences to 90 days to 5 years on my second dui (i fell under the 3 rd teir of my bac) my last dui was 9 and a half years ago.the judge gave me 5 days in the county jail and 85 (ancle braclet) days of the intermiade punshiment program. my question is will i be on probation for that whole 5 years or after a year or 2 can they dismissed the rest of the probation peiord. they say i can not have no booze in the house for 5 years. what about my wifes rights as she own s half the house too.

Of course, no one can answer your question without reviewing the probation agreement..... but normally, you would be required to serve the full probation.

I just re-read the Constitution and can find NOTHING about your spouse having any 'rights' to have booze in the house. So, if she is a boozer too, she needs to divorce you and move out in order to be able to have booze in HER house.

You need to stop drinking and stop worring where your next drink is comming from, obviously you didn't learn a lession last time did you? You need to make this a lifetime commitment, not just enough to satisfy probation. Only the court can say how they will sentence you, much will depend on your history, which is that of a repeat offender. No alcohol in the house means just that.

I was wondering that as well? Perhaps a braclet belonging to a cross dressing aunt/uncle? :D

I doubt that will be the case.... at least for those of us who don't LIVE or drive in Pennsylvania!!
But then that depends on what 'proabation' is, huh??? :D

Well, Mr. DUI...Honestly, you should have gotten alot more than that....my family and myself drive everyday, I have children who mean the whole world to me...one of these days, you are going to kill someone drinking and driving and you'll have manslaughter on your hands..I'd be really happy with only probation and house arrest. What they need to do is refrain you from driving for the rest of your life. Obviously, if all you can worry about is how your wife is going to drink, maybe she needs to go to AA, just like you need to. Be happy with what you got..in my state, they don't take drinking and driving lightly. Get yourself help because one day you are going to drink, drive and kill someone or yourself.
