I hold a Ph.D in a certain field of engineering. I am working as a software engineer. I have two publications. Question is - does having a PhD allow me to apply in EB1 category or is there any INS regulation that says that I have to be working in the same area in which the PhD was awarded?

I do not know the answer to your question.. however, GENERALLY, any work related visa has to be in the area that you have your education or experience. Stops people with a social science degree coming to the US and working for McDonalds flipping burgers.
