We are dealing with the state of oregon here. I am only 18 and I come from a really poor town and I'm one of the few kids to "make it out" and go to college. I recently got a panicked phone call from two of my buddies in my home town (both are almost 19). They were desperate for advice. The earlier night the two of them had gone to a party and ended up having sex, yes both of them, with a fifteen year old girl. They were all intoxicated. I know this sounds bad already, it gets worse. They filmed it, and told me that the film proves the girl was able to make clear judgement, and invited the two of them to engage in the sexual act. Whether such a tape would work in their defense or agaist them im not sure. But the girl went to the police the next day after a heated arguement after her BOYFRIEND found out about it! Ah the drama. From what I've read the best they can hope for is a mandatory 75 months, unless I can find another answer or some kind of loophole. Please someone must know something. These are genuinely good kids who don't deserve to be punished THAT harshly. Oregon state law is very strict about these policies, see measure 11. Please help me save my friends!!!

I thought so. If they were try to evade the police, would there be a set # of years after which the charge will be dropped or at least lessoned?

If they try to evade the police, matters will only be worse.
You also know re the video, if you are called as a witness you will have to tell the police otherwise you could be aiding and abetting. Also if she knows about the video, it is evidence it is up to the attorneys to argue what it means, but statutes are clear on this issue.

Well thanks for your help, knowing my friends they are probably long gone by now. I know neither will stick around to appear in court. Good luck to em, and I hope they've learned a valuable lesson. And furthermore, wouldn't anything I present in court be hearsay, since I never actually saw the tape and was only told what happened over the phone?

Why do people always confuse what the definition of statute of limitations is?

What do you think if you have a warrant out for murder, after seven years they just forgot about it? Or they lessen the charge for you because you were so good at evading the police for seven years?

Statute of limitations would pretain to how long the LITTLE 15yr old girl had to file the charges, not how long your buddies can outrun the cops.

-THE SIN MAN

FYI. I'm not sure about the laws on this, but you should come forward about the tape in my opinion. A good defense (if you were called as a witness) to withholding evidence is not: I thought it would be considered hearsay so I did not come forward with it.

You testify to what you know, and what they told you.
So you are happy that the comitted statutory rape and are such chickens that they will give up their whole future and run, what lesson have they learned? So while you are safe sitting in some college dorm they are on the lam, why don't you call the police and let them know what you know. That is called civic duty.

You know how it is. "Boys will be boys!"

Can someone please hold my hair while I vomit? This scenario disgusts me.
