My hubby has joint physical custody of his son. His son just went back with his mom for her year, on Aug. 3 2002 Bio mom told us a week before picking up son that she and the kids were moving to Colorado till xmas, so that her and hubby can buy a house. Bio moms hubby is living out of the van in Montana.
We just got a call from the bio moms sister in law, notifying us that the bio mom is sick of the rules and that she is planning on taking the kids and moving back to Montana where they will be homeless. The bios sister in law recommends that we go to court right away and get custody. We plan on that, but I cant remember what papers to file, I have a web site for the courts in Washington, but I dont see the emergency form I need to download. Do I just bring in a completed parenting plan changing custody, or what. Please help!!! I'll answer any questions you might have. I'm planing on filing papers on Monday.:( :(

Bio mom has custody for a year?

You already have the custody order right? Does it already restrict where biomom can or cannot take the child?

You need to file a contempt motion and seek termination of custody.

Problem is how to serve biomom and enforce the order. Is she in Washington presently? Can your hubby pick up his son and bring him back and then file the motion?

Things have changed!

Well I talked to the sister in law again, and she told me that the bio mom had left with the kids to go to a shelter. So my hubby called the bio mom and asked her why his son was in a shelter. She said things weren't working out, so she left to the shelter. he asked her if she thought it would be best for their son to come live with him, his son said yes!! So we booked a flight for tomorrow morning, he;ll be here by 10:30am. My hubby and I are so happy:p :D :D :D She says she'll be back to pick him up in a month or month in a half (shes in another state.)
And thats fine with us, we miss him so much. So it will be nice to have him back.(I know he's only been gone for 3 weeks but still:p ) If you have any comments, or suggestions I'll gladly take um...:p ;) :) :D

custody

If you have a Custody Order in place it should say whether she or you can move out of State. If she has a major change in finances you can Petition the Court for change of Custody due to that change.:rolleyes:

We have joint phsical custody. She normally resides in montana, and we reside in washington, we had my step son from aug2001to aug.2002, my step son went back with his mom on aug 3rd this year, now shes homeless. She was supppose to be staying with her sister in law in colorado, while her hubby lived out of there van in montana until xmas, so they could save enough money to buy a house. But things werent working out at the sister in laws house(she didnt like the rules) so she took the kids(my step son and her other 3 kids) to the shelter. Tahts when my hubby called her and asked about his son coming back here. We would love it if we have full custody, but I dont know if we should go for it, or leave things alone, and enjoy what time we have with him. Thankyou for your response:p ;) :D :)

Well, here the update... My step son is back here with us!!:p :D :D We are so happy. He'll be staying with us for awhile. His mom says for a month or so, but I think longer. Should we file anything in court, so its on paper or not? thanks Grace for your replie, I was wondering where you were? :p ;) :D
