When you don't know the exact situation why do want to give your free unwanted advice.My employer can lower my salary but its not my choice whether I would like to sign new offer letter for visa extension with lower salary or not and I choose not to .But still he has to give me salary till I worked with him whether I am on project or not.

Read the TOS. We give free, and often unwanted by the member, advice. Almost NEVER wrong though. You always have the option of taking your bottom to an attorney and PAYING for advice.

We are also here to get free advise ,that doesn't means that anyone without knowing our situation can say that we are doing illegal work.
Just for FYI almost in all IT companies consultant has to work at client site which is totally legal and even our LCA and visa is filed for that work location.

Hi ,

I was on H1B with my previous employer ,my expiry date of my visa with them was 8/20/2015 .They were not ready to extend my Visa if I don't sign offer letter which was less than 20,000$ less then my current package at that time.
Hence I didn't sign and they have not extended my visa.
For last 2 weeks I didn't go to client side for work and submitted time sheet for 0 Billable hours.
Now that employer is not ready to give me patstub which I need to show my my proof of employment till 8/20/2015 with them.
According to H1B rule actually they should have pay me as well.

I am thinking of filing DOL complaint please suggest if should I go ahead.

My understanding is that OP's H1B visa, sponsored by his previous employer, expired 8/20/15. OP had 2 weeks to go on the visa when the employer offered to extend the visa... if OP would take a 20K pay cut.

Rather than work until the visa expired, OP essentially quit. OP wants a pay stub with 0 work hours to fulfill a paperwork requirement.

OP's current employment status is unclear. "Previous employer" could mean OP is working for a different employer or not working at all.

Frankly, the fact that anyone would give OP an H1B visa is shameful. This person is barely coherent, and is utterly incapable of communicating in a professional manner.

Yes you almost understood my situation.I already knew that my previous employer is going to take advantage since my I-140 was approved on 8/01/2015 and since I am entering my sixth year he knows that I don't have any way but to stay with him.Hence as a backup I already excepted the offer from my current employer so that I shouldn't be out of status after 8/20/2015.My intention was not to leave my previous employer since I waited almost 2 year to get my i-140 approved and since I was entering sixth year hence difficult to get new I140 approve before completing 6 year.I took a decision not to allow my previous employer to take advantage and left him. So he didn't paid for last 2 weeks to me.

It's connected, as it seems that the point of this thread is that you're trying to get your documentation of employment together, and your former employer is unwilling to cooperate.
