Evaluator's Reccomendations....

What is the name of your state (only U.S. law)? Indiana

I have been looking for all of the information that I can find for a certain evaluator in Indiana. She has done a lot of evaluations according to her, my attorney, the GAL, other attornies that I spoke to. According to another attorney whom I spoke to she has a trend of finding in favor of the father. There have been several cases where she found in favor of the father, and the father returned the child to the mother shortly after he was awarded custody.

Anyways, I have found a few other women who were vicitims of domestic violence like I was, and they had the same evaluator. She found in favor of the father in their cases too. We've compared the results to a study that was done about custody evaluators, and we've found that some parts of her reports are the same as those quoted in the evaluation study. We have also found that some parts of our reports are verbatim the same.

What can we do about this evaluator? She is a Psychologist with a Psy.D. She is well liked by many,and she is married to prominent physician. How can I find her history of evaluation outcomes? Does the State or County keep track of such a thing? Our our reports legitimate if sections of them are verbatim except for the names, and in some instances she refers only to Mother and Father, so the reports are the same.

Any ideas where to start, what to do from a legal standpoint?

My ex paid this woman over $10,000 for the evaluation. I am afraid that she is a quack.

There are no historical listings of the outcomes of custody evaluations.

Does anyone have any ideas about something that can be done? How could we find other people who had evaluations done by this doctor?

Would there be anyway to bring a suit against her that would discredit her if as we suspect she almost always recommends that children be placed with their father's? More than that, her reports are almost the same. It looks like she starts with a basic report, adds names with the find and replace feature in Word, and adds a few details such as MMPI scoring, but those comments are similar everytime.... It appears that she asks the father if he did this and that, what makes mom a bad mom, and then puts that in her report. Then she waits a year, prints it out, and has the GAL file an emergency petition for the father to get custody. Then she presents her report in court. The dad's side supposedly does not know about the report, but hello, how does the GAL file for dad to have custody without him knowing, agreeing?

I know that there are some really great evaluators out there. I also know that there is no right or wrong answer. They are usually psychologists asked to review the information, interview the child and parents, and look at the whole picture of what is best for the child. I know that it is not "exact", but I do believe that there is a problem if one evaluaotr consistently rules that the mother is unfit and that (in all 3 cases I know of) mom should have supervised visits, and dad should have sole legal and physical custody.

Any ideas? Suggestions?

If you are really serious about this, then you would want to take what evidence you do have, and get a consult with an attorney that specializes in civil law. (not family law)

You may possibly even want to look at an attorney with experience in class action cases. However, not huge class action cases.

An attorney will know whether or not you have a case, and will know the right steps to follow to identify other claimants.

If you just want the evaluator investigated, then you might take other steps, like contacting the local press.

I will get these women together to form a class action lawsuit if possible. I am going to speak with them over the weekend, and approach the subject of a lawsuit. I need to find a good attorney this time, NOT the one I used in my custody suit.

I did contact a few investigative reporters. One said that I had to bring all of the evidence to him before he will persue a story. No problem, BUT I need to find more of her clients.

Another said that he's already heard all about her. From where?? And Why hadn't I???

Hey, I had a great idea I'm going to search the Indiana Appeals Court files for her name.... That might prove to be lucrative....
