What is the name of your state (only U.S. law)? Oregon

We received a summons for eviction over a week ago (late rent). I contacted the rental property management and made arrangements to pay the rent (we are now fully caught up, it was a freak occurence) and was told that they would dismiss the case and we'd just have to pay the fee. Well, my husband took them a cashier's check on the first and paid July and August rent in full.

Imagine my husband's surprise when he came home today from helping a friend and there was a restitution notice posted on our door saying we have to vacate the premises by midnight on the 11th. Of course, we can't get a hold of anyone at the property management agency.

What little I've been able to dig up says that they *can* do this but they have to reimburse you for the overpaid amount (for us this would be for the rent after midnight on the 11th) within four days of being paid. Well, it's been longer than four days.

They have our rent in full for the month (not to mention our huge security deposit). How screwed are we? Help?What is the name of your state (only U.S. law)?

Update: Finally got a hold of the property management company and the situation is resolved. Apparently the lawyer screwed up. *whew*

You don't mention that you paid the legal costs, etc. either.

I would think any remimbursement if mandated would be XX days AFTER you have vacated. You still owe money for the time you are there and they can't be sure you really will leave until you do. Are you seriously going to wait until the day of lockout to move??!!

We paid, in full, on the first. Yes, I know we need to pay them for the court costs. I think my husband did so. It was a whopping $150.

We don't have the money to move right now, won't have any money until Saturday. And then we'll be sleeping in the van and all our stuff will be in storage. All of our nest egg got demolished in the costs of moving down here.

And this has happened rather quickly, mind you.
