My girlfriend and I had an apartment that was in her name. We lived there for about 4 years. We payed our rent in full every month. Sometimes it was late and we were charged a late few. Other than that, we were good tennants. Our landlord wanted to get more rent out of the place. She was charging us $550, but she wants to get $600 out of the place. Since she can't raise our rent that much, she wanted us out. I got in an argument with her in early April. I told her we'll be moving at the end of May. About a week after that an inspector knocked on my door, and said he needed to inspect the building because it needed major repairs. The landlord told all the tennants not to let him in. She knew she would have to finally fix the place if he was let in. I let the guy in because I knew it was the only way to make the landlord fix the place. It worked, and she had to do major repairs to the place to bring it up to code. Well, because of this she is trying to screw us over. She started the eviction process on us even though we had been paying our rent in full. But about a week after we got the notice of eviction, she told my girlfriend that she was going to drop the case. So we thought nothing of it after that, which turned out to be a huge mistake on our part. As we were moving everything out on May 31, a sheriff shows up and serves us with papers to get out of the apartment. It kind of shocked us. I guess the landlord lied about dropping the case so we wouldn't show up in court. Now my girlfriend is going to have an eviction on her record. What can we do to get the eviction off of her record? In the future I'm going to make sure I know every detail of any legal case. We really got screwed because we didn't pay attention to details.

Yikes!

This is and was serious biz that will be part of her public and credit report for a VERY long time.

It may be too late unless the landlord is willing to have the eviction vacated.

Say screw it. When your gf goes to get another place, have her explain. She should tell the new prospective landlord what happened, and that she can call the old landlord to verify the payment history. Legally she must be truthful. Of course, it helps if she kept copies of the checks. My aunt Kristy was evicted for having over a dozen rats roming in her apartment as well as a....chicken. A live, crowing chicken. Inside! She was evicted two months ago. She now has a new place. Of course, she is also an able-bodied adult on welfare with two kids and a third on the way and no plans to work and the father of the third lives with er. But still. As long as your gf explains, it should prevent little problem.

I'm not worried about it being on her record for getting another apartment. I just bought us a town house, that is in my name, so at the moment it isn't a problem. Does this eviction go on her credit report? That's where it may hurt us. We plan to by some fixer-uppers in the near future, and flip them for a profit. It would be a lot easier to get a loan with both of our names on it. So I'm worried that this may lower her credit score, or cause a loan officer to decline a loan. It may also hurt her in trying to establish credit for herself. If it doesn't go on her credit report, than this shouldn't be a problem, unless we break up and she tries to get her own place.

You never did mention what happend to your deposit from this last place ? so what became of it . Yeah you should have gone to court but thats too late for now so Look and see if what became of the court hearing by going to the clerk of the court and simply asking to review the file under your GFs name . Untill you do see it you wont know for sure what the courts record says .

Yup the landlord pulled a fast one on you.....

In fact if you were paid up with the rent and went to court the eviction would have been DISMISSED!

And she would have to start the whole process all over agin....

Guess you should spend less time with the gameboy xbox sega, weekend SPORTS....and spend more time reading what is sent or given to you!

Evictions do NOT necessarily get dismissed if rent is current. It appears the LL filed the eviction for other reasons.

Yes - Jason This will be on her credit report which may take 1-3 months to appear on her report. Credit reporting agencies seek out judgements on a person's public record and report them on a person's credit report.
