I own a unit in a complex of approx. 300 units. The assoc. fees are $224 a month. When I bought the unit 2.5 years ago, the fees were $219 and covered, ext maintenance and liability, water, cable, pest control, trash, grounds/pool maintenence.
Since I purchased the condo, the fees have been raised $25, we have been charged 2 $500 special assesment fees, and they stopped paying for cable. The complex looks horrible. The dumpster is located at the front entrance, off or a busy street, with no gate, the dumpster is constantly surrounded by misc. pieces of furniture, old appliances, etc. About twice a month the dumpster breaks, people pile bags of trash all the way into the road entrance. We have what appears what was at one time a nice, pool with double decks, but it is not maintained. There are a few old, broken lounge chairs and a single cement table with a broken bench.
What should I expect from my assoc.? Is there some kind of standard they can be accountable for?
I have a unit on the top floor, the roof leaked, after 5 calls and almost a month of waiting, the leak was repaired. From what I have been told the ceiling is interior, therfore my responsiblity. Are they not responsible if it occured b/c of ext. leak? What language can I look for in my bylaws?
Once, they had the buildings pressure washed, the workers sprayed the pressure washer directly onto my window and porch screens, ripping the screens apart. I didn't complain. A month later I get a nasty letter saying my broken screens are a violation and I will be charged a fine if I don't replace them.
I know they collect the assoc. dues b/c I got 4 months behind once and was sued and a lien put on my house.
My main concern is the appearance of the complex. I think I would have a hard time selling with the way things look. The woman I purchashed the unit from was the president of the board of directors, she told me how great the assoc. was, that they had tons of reserves, etc. Is there anything I can do?
One question I have-Units in my complex sell for $90-95K, mostly renter occupied. The assoc. also manages several multi-million dollar neighborhoods in the area. Is my property neglected b/c we bring in less money? Any advice would be greatly appreciated. Has anyone had any success dealing with an hoa? I love my unit but I want to sell and get out of here b/c of these tyrants!!
