What is the name of your state? Ut

My ex wife has custody of our 4 children, ages 11, 8, 4, and 3. She recently has dicided that it is ok to put the children to sleep and then leave for a few hours after midnight without a sitter of any kind. Im not sure if this is an important thing but my 8 year old has epilepsy to add to the mix.

What rights do I have when it comes to her leaving the children alone like this.

Well this very thing was one of the things that cuased our divorce to begin with. I have made it a point to make sure that my children are being watched becuase of her history of leaving them home alone to go to the bar. I live close our old house(which is were they live) and I saw her leave the home without the children with her. I work nights and get home around midnight every day.

you should have called the police and had them knock on the door to check the welfare of the children. Hopefully one of them would have answered the door and say mommy was not there. The police would have searched the home for her and finding she wasn't there, charge her with child neglect. You would have then be able to take the kids to your place until the next step....which is up to you.

And so you sat and waited to see when she came home?

No instead I did just what rn12rw2 has suggested here.

Thank you. I wasnt sure if this was right.. This is the 3rd time this week that she had done this. I had no real proof until this time (had only what my 11 year old had told me).

How are you 'making it a point' to make sure that the kids are watched? Are you watching her house?

If you called the police, and they discovered that the kids were alone in the house, what happened next?

Im sorry. I cant afford PI so I drive by the home every night on my way home and I have some family help watch as well. As of yet there has not been any charges made to her about this, I have no idea when she finaly came home and she has not tried to contact me as of yet. This was just last night when this all went down. I did take my kids home with me.
