Hello,

My Fiance is here on a F-1 Visa that ends in September which means she would technically have to leave with in 60 days after her studies end. I am wondering what my options are to ensure that she doesn't have to leave within 60 days. Any help would be much appreciated.

The first question you have to answer is what your immigration status is. Are you US citizen? LPR? What?

Your options are to marry her and file to adjust status or to have her depart and reenter under a K-1.

To clarify, a K-1 visa is a fiancé visa and you would have to marry within 60 days of her arriving back in the US. So, one way or another, she is not going to be able to live here unless you marry her or she finds some other legal way to get permission to live in the US, and all of those require her going back home first.

Thanks for the help much appreciated! So if I do marry her before she is forced to go back can she stay here while the papers are processing or she has to go home first and wait.

Since she came into the country legally, she could stay here while the papers are processing.
