What is the name of your state (only U.S. law)? Pennsylvania

My girlfriend was born in 1991. When she was born, her last name was Onder. Her mother kept her biological father from her. As she got older, her mom got a new boyfriend/husband, and they told her that he was her biological father. When she got older, she caught on to her father treating her different and found out that he actually was not her real father and that it was all a lie. Prior to this, when she was very young, her mother and "father" went to a family friend and had her birth certificate changed and her last name changed to "Rieg" although no adoption ever took place. Now, she wants to have her original birth name back because her father treats her TERRIBLY. How would we go about getting her name changed back. We wanted to go to the lady that did the name change illegally and threaten her with legal action if she didn't undo what she did. Is what she did wrong? Is there a way to get this fixed?

Who is her LEGAL father?

Since she was born in 1991, she's an adult now. She can use any name she wishes. Filing for a legal name change is probably a lot easier than messing around trying to do what you're suggesting.

Furthermore, you don't have any idea that anything was done illegally or that the parents didn't do an adoption. It just plain doesn't concern you, anyway.

If she doesn't like the way she's being treated, she's free to get a job so that she can support herself and move out.

It does concern me, she is the mother of my child. Also, she asked me to find out info on it.

Her legal father? We do not know because no adoption has ever taken place, they went to a family friend that did this kind of stuff and she had the name switched without any adoption process. Her original birth certificate has her name as Onder and no father on it. Then, they got a 2nd birth certificate with the non-bio father's name on it. The way it was explained to us, it sounds like they just filed for a new birth certificate and somehow had the names all switched around.

It's not so much about the moving out/support herself, she doesn't even want associated with the family that she shares a name with. They're off-the-wall, crazy, ridiculous, .

However, I said the same thing as you mistoffollees, that it'd probably be a lot easier just to file for the name change rather than try and get it done for free and proving what she did was illegal. But that's what she wants, she wants the lady to know how messed up her actions really were, and she doesn't want to pay (I always heard that it was an expensive process).

The birth certificate is in Pennsylvania also...

It sounds like what they did was what a lot of people call a "back door adoption".

Her original birth certificate did not name a father. Her mother's husband then signed the AOP stating that he was her father, and therefore his name was added to the birth certificate and her last name was changed.

If she is a legal adult, and I assume that she is if she was born in 1991, then she can simply file in court to change her last name if that is what she wants.

However, when/if she ever marries, her last name will (or can be) changed anyway, therefore it might be more expensive and more of a hassle than its worth.

Thanks ldji...I appreciate it..

stealth2, i'm not gonna sit here and fight with you because I only joined the forums to ask this question...I just wanna know if you have a significant other, whether it's a girlfriend, boyfriend, husband, wife, whatever....if so, and they ask you for help with something, do you tell them it's not your business and not help them? if you don't have a spouse of any sort, that is probably why you don't...

How do you figure it would not be my business? ESPECIALLY since she ASKED me to help...I'm sorry
