I received a phone call from a person claiming to be a lawyer and was threatened with a lawsuit for slander based on a personal situation.
I proceeded to ask this person what their name was and what law firm they represented. I was given a name, but not a firm name. I was told if I wanted to know what firm they worked for, I could look it up myself. Which I did. I was unable to find any lawyers with this name in my state. I also tried to locate them by first name only. I found 9 lawyers with this particular first name, but not a matching last name.
My question is, if this person was not really an attorney, is it illegal to claim to be one and threaten someone with a lawsuit? Also, if they were really an attorney, but gave a different or possibly false last name, is this considered misrepresentation and can I report them to the bar association as a complaint against them?
