I live in california and have been divorced for a short time. We have one daughter (15). I have just found out that my ex has resigned from his job and is going to move to New york to work, for alot more money. if he leaves our state isnt the support supposed to be recalculated he was suppose to have 25% custody but never even kept that up. he tells me I got nothing in court (because his lawyer was a snake)and i will get nothing again. will he be able to hide his salary in gifts like i believe he will try to do. His new employer will be an individual and it is not a company, therefore he wont have anymore insurance coverage for our daughter. what can i do, i cant afford another attorney but need to fight.

His departure from the state wouldn't necessarily trigger a modification in child support.

But his increase in salary could be grounds to show that there needs to be a modification.

If you cannot afford an attorney, you can always represent yourself.

If his "buddies" are supplying income information, you can get it in other ways -- such as asking for information (and proof) of his living expenses, which can be used to show his income.

If he says he only makes X, but his living expenses alone are X+, then any judge will see he's lying and impute (or assign) a certain level in income, which would likely be an increase over the old number.

thanks for the help. sometimes professional athletes have a way of getting away with things, and im afraid he is going to be able to hide alot. by him moving out of state there is no way he will be able to have 25% coustody, so i will no longer have the little help i did have. Can the DA be of any help to me in reviewing my support payments? thanks
