Fatal Car Wreck

My son was in a fatal car accident in December. The passenger in his car was badly injured and was in the hospital around 5 weeks He sustained brain injuries and may never be alright or could have extensive rehab. This young man was 20 years old my son was 30. My son was buying his car we did not co-sign for it, And he did not have car insurance. He lived at home with me and my husband, and I wrote a check for his last car payment out of my account and he paid me back when he got his paycheck. He had no estate or owned any property. He had no assets or life insurance. We have heard through the grapevine that this boys family are going to try and sue my husband and I for his hospital bills & ect...Since my son was 30 years old and buying his car himself is there any way possible for my husband and I to be held liable for this young mans bills? I would be thankful for any help you can offer on this issue.

I'm sorry for your loss.

While on the surface one might guess that you would not be responsible, there may be a number of ways you might become responsible.

Did you know he didn't have insurance?

Was alcohol involved? If so details?

What was the purpose of the two being in the car together with your son driving?

Why is a 30 yo adult living at home?

Contrary to what others might pose as to imaginary 'what if' questions... the fact remains..... there is NOTHING in your post that would indicate a court including you in this matter. Your son was an adult, the car was NOT in your name, and the fact that he was still living with you is not relevant.

Hello and thanks for you reply ...I was not made aware of the insurance issue until after the wreck.

There was no use of alcohol involved in the accident.

My son and the young man that was with him were friends and he was riding with my son to pick up my sons girlfriend from work.

My son had moved home to save some money and pay off some bills.

It would appear that there are no other reasons that you might be found responsible and more than likely, what you are hearing through the grapevine is just that unless there is something you didn't tell or don't know. They are suffering their own shock and grief. Needless to say treatment for serious traumatic brain injuries is expensive and overwhelming without insurance to cover it, and there is no doubt that their son will never be the same, so they are suffering grief as well. Most states offer some programs for uninsured injuries and rehabiliation, contacting this link will provide some resources for their family in case you are pressured re this:

You are welcome, there is little that can be said in times such as these and little that can be done. Each family will have to work through their grief, and no amount of money can turn back time or replace what is lost. Hopefully they will get linked up with the resources for brain injury in your state. I wish I could be of more help and again, I'm sorry for your loss.
