father not involved with child

What is the name of your state? Tennessee

Me and my child's father have been seperated for over 3 years. We were never married; however he is on the birth certificate. He does not pay any child support, even though the court has ordered him to do so. He also has not seen his daughter for two years. He is the one who has chosen not to be involved in her life. She has a serious handicap and has life-threatening seizures. This scares me because if he were to show up at my door to see her he wouldn't know about her medications and other things. I want his priveliges taken away. Is this possible, and if so what should I do to start the process? Any information will be appreciated.

sorry you cant

unless you have a husband to adopt your child,he cant just sign his rights away-you need to take his back to court to enforce the child support order.hes legally obligated to support her wether he wants to or not.

How long has it been since he's paid support (if ever) and how long has it been since he's seen the child? Check your states Family Law codes online for what the requirements are for abandonment to see if your situation meets them.

Normally I don't encourage terminating parental rights or filing abandonment....because things can always change, but in this case considering your child's condition- it could be very risky if you felt he would not be cooperative in any specific restrictions for visitation.

Are there court orders giving him visitation rights? If not, then you are not required to allow him unsupervised visitation. He would then have to take it to court to attempt to obtain rights. Considering your child's condition, if it was argued properly with a judge he certainly would have to, at a minimum, get fully educated on your daughter's needs prior to being allowed to see her alone.

If there are court orders giving him visitation rights then you have two basic choices. You can either STILL refuse to allow him unsupervised visits and IF he files contempt you can explain the situation to the judge...which is likely to have the same outcome as above....or you can take it back to court now and ask that his visitation rights be suspended.

My honest advice would be to simply leave it alone until the time comes that he attempts to see the child....and then deal with it then. Sadly, I think its pretty unlikely that you are ever really going to have to deal with the issue.
