My son's father told our son that he has a lawyer and wants to take me back to court to get custody. My son will be 12 in less than 2 months. My son is really sweating this. He is not very fond of his father and doesn't want to live with him. My son is in a LD classroom because the school came to me and told me how he was struggling. His father doesn't want to see the fact that he does have a learning diablity and wants to put him in a school by him and more than likely pull him out of LD setting. He always tells our son that he doesn't want him to be in an LD classroom cause he use to make fun of those kids when he was in school. This past year my son was on the honor roll all year and even got a trophy for it. Why would his father want to see him struggle and not succeed in school? I try telling his father that just because he is in an LD classroom that he's not stupid, he just needs to be taught a different way from other kids so he can understand. I also talked to my sons doctor about this and told him that my son was an A, B student and what his father wants to do. He said that his father should leave well enough alone and that he wouldn't change a thing. Why does my son's father have a brick wall for a head. My son doesn't even want to go over there just on his weekends. He gets really depressed when he has to go. My sons father is also trying to bribe him to get him to move in with him. His father told me that he can't spoil him because I've taken all the fun out of it and that he doesn't see him but only on weekends so thats why he can't spoil him. He tells me that he has off on such a day and that he's going to pick him up and spend the day with him and it never happens. He clearly is a loser there's much more to say but don't I don't want to make this a book since its already turning into one. My question is, can he take me back to court to say he wants full custody and is this in the best interest of the child? And what would his chances be? Personally I think he's trying to get out of paying support. It was just increased back in Nov. of 2001.
