father wants residential custody?

What is the name of your state?ohio
I have a two yr old son, me and his mother never married so i have no custody of the child. I have established paternity. My question is, how hard is it going to be to get custody of said child. Mother works nights, and keeps pawning child off on me. I have documented eveything. I am just worried about the child. He spent the entire week with me, then on Sunday,yesterday, she came to get him at 12:00 at night, in the middle of a snow storm. I told her to get the police because i was not going to wake him and give him to her. Which she did, and they made me give her the child. I have taken care of this child since birth he calls me momma, and daddy. I have cotacted the local legal office and i intend to go there tommorrow. Ant suggestions on what i should do, any advice is better then none.

There's not much anyone can tell you here except take anything and everything you can to your meeting with Legal SVS. including your documentation.

Ask that they file for full custody and support and liberal visitation for the mother. then get ready for the crap to start.

Also inquire about an emergency custody hearing as soon as possible.

It's your only option.

Why do you consider your child as "pawned off" simply because you watch him while your ex works? Are you not responsible for your child too? Everyone has to work to pay the bills, and if parents can't share "babysitting duties", then he'd go into daycare instead. What do you do with him while you work? Taking care of your child should not be thought of as a burden. If the mother works nights, then unless previous overnight arrangements have been made, of course she's going to pick him up at the end of her shift.....no matter what time that is.....it's her duty to do so. Making her call the police to take the child home, and the request was granted, should have been a wake-up call to you......you are playing games. Legal aid isn't going to do a thing for you.

i mean by pawning him off, so that she can go out and party I am 24, i always take care of my son,she left him with me for a week, with no phone calls, or anything to ask how her son was.she is 21 her main goal is going out and having fun.Sorry, but the fun stops when the child is born . I just want her to be there for the child. Maybe i expect to much, having been raised by a loving single mother.

i pay all child care bills, i buy the diapers anything our child needs, also i give her any money she needs. Whether it be for him, or for her

Ok BBreeze told you what to do. You need to go to the court house and file for a custody hearing if you want to have any enforcable rights to that child. If paternity has been established then start there. You can go online and find the forms you need. Make sure that you document every time you have the child. Also I think the "crap" BBreeze was talking about is that well honestly custody hearings can get ugly. If you have read many post on here you can see that to be true. Just try and make sure to act as the adult and loving father that you seem to be. No one can tell you what the judge will do but your child is worth at least trying right?

thanku for your reply,and my son is worth more then just "trying". I would like to know of any such examples of father gaining custody, whether it be personal opinion, or some link of some kind, again thank u
