I had a 77 toyota that had a speedo that read faster than actually going. it wasn't of exactly 5 or 10 mph, it was of exponetially - meaning the faster I went the furture off it was.
Sounds like since you were aware of the problem, you should have been carefull through that "known" speed trap.
If you fight the ticket using the "following the flow of traffic" agument, you may or may not get off, and most likely will need to have it fixed and prove to the court that you fixed it. You are talking big money to get it fixed, so just pay the ticket so you aren't ordered to fix the problem. Good luck!

Actually, my speedometer gets more wrong the faster I go too.... it's not too bad at very low speeds... I found a place that will calibrate it for $15--that is, if they don't have to replace any parts or anything. I'm going to get it done on Wednesday and hopefully that will prove that it was beyond my control.

Yeah, you're probably right about being more careful though... I mean, I was watching the signs really closely, but I guess I should've just crawled along since I didn't know exactly what speed I was going.

I have one last reply to you, spawn_x--

First of all, if I was simply trying to cheat the system and weasel out of a ticket, I would just say so. What do I have to lose? Why would I waste my time lying to a bunch of nameless, faceless people on the internet??

Secondly, I really expected more from the members of this forum. I really thought it was a place for people to share their experiences and express their personal opinions or advice on legal issues in an environment of mutual respect. I didn't post here to listen to people's insults or opinions about my choices or my integrity.

You did not bring it up as an honest question to weasel out of the ticket, you asked a question and were posing "innocent". If you would have simply asked "I got a speeding ticket, my speedometer wasn't accurate, can I correct it and lower the ticket/dismiss it?" then i would have gave you a completely different response.

However you were playing "stupid" and saying "it was out of my control", that is what gave you these responses.

You may not want to mention in court that your speedometer was miscalibrated. That would be as bad a pleading guilty. I've watched a few people in court try to plead guilty with a reason and sometimes it works, sometimes not. A judge here in my town frequently gives people a probationary period (I forgot what he calls it) But basically, if they don't get another violation in 6 months, 12 months , etc. then the ticket will be dismissed.

Uhh, that's my real name retard. Don't you think I catch enough hell about that! Do you realize how many Theodore Bundy's are in the world? It's quite a common name. For your information I was born well before anyone had ever heard of the "other" Bundy.

Shame on me for using my own name! At one time I used to go by Ted, but because of dorks like you I had to start using Theodore.:p
