For several months now I have been fighting with FEDEX on an $800 claim for shipping a laptop.

Here is a quick (somewhat) rundown:

I purchased a laptop on EBAY. The shipper shipped it to me in a factory sealed box using FEDEX. When it arrived, it was in a white box with a package damaged label from FEDEX. I imeediately called FEDEX to tell them that I don't want it because it has been damaged. They picked it up for investigation. They said "although package was damaged, computer works." The argument that I had was that the computer was factory sealed, and it longer is...meaning somebody broke the seal. The laptop then was circling in transit for over a month finally ending up back with the shipper. Now I am out $800 and a laptop. I have the email of a person at FEDEX, and I have sent several emails to her asking for my computer back...with no reply. The Shipper has been nice enough to work with me so far. In fact he has sent an email to the FEDEX person we are dealing with stating that it is now missing the power adaptor...with only a response of "bill us for the adaptor"

Can anyone please offer some advice on how we can get our $800 back and/or the laptop???

Tell them that you, or the person who sold you the computer, are going to turn them into the Attorney Generals office if they do not clear up the matter and that you will report the matter to the Better Business Bureau.

You state that the laptop is back with the original shipper. Why not just ask fedex to pay for the shipping to have it shipped back to you and to replace the power adapter? They said that you could send them a bill for the adapter. That way you end up with the laptop that you paid for. Just because the box came open, if there is no damage to the laptop, you are not entitled to a new computer. FedEx, just like most carriers, has a repair/replacement value. If the laptop is not damaged, there is nothing to repair or replace other than the power adapter and they have already told you that they would replace it for you. They won't necessarily just give you the money because it isn't considered insurance coverage. You show them that you paid for a replacement and they will refund you the money. The laptop box could easily have been damaged by another box hitting it, getting caught in high-speed sorting equipment etc. There's no way to prove that someone deliberately destroyed the box. And anyway, why would they unless they were trying to steal the laptop. Obviously, it wasn't stolen so it does seem that the box damage was just an accident.

Also, I have to ask: Why did you make them come and pick up the laptop without seeing if it was even damaged in the first place? You could have saved yourself a huge headache. You make it sound like they did all this on purpose. FedEx is in the business of delivering packages, not destroying them. I'm sure whatever happened wasn't intentional.

If the laptop is in fact damaged, then the shipper should refund you your money and file the claim with FedEx to get the computer repaired. If it cannot be repaired, then it will be replaced. Either way, the shipper can then ship it back to you.
