What is the name of your state?What is the name of your state? VA
I am about $36,000 in credit card debt. My monthly payments around $550. I make about $675 a month. I am married but I will be filing bk by myself. I talked to a lawyer today and he wanted to know hom much $ I would have if I didn't have my credit card bills. I told him I would have $550 more a month. So, he said since I would have money left that I would have to file chapter 13. I don't understand why I can't file chapter 7? Also, my name in on the title to our house but on the loan. Will this affect my husband? We also have a joint checking account and we recently refinanced our home and got cash back to get a new roof on our house. This money is in our checking account untill we can get a new roof in the spring. Will that money affect my filing?
Also, when I fill out my papers for filing and where it asks all my living expences should I just split all the expences in half like my husband requires me to pay half of all expences?

Listen to your attorney. He/She is providing you with correct information.

You've a fullblown mess on your hands with masive debts and comingled assets.
Nobody is going to let you blow off the cc's and start sticking $500/month in the bank.
What sort of payback did the lawyer think you could get with a Chapter 13? Please don't try a 7 pro se with this sort of tangled situation.
