I’m from Maine last year I was accused of allegedly night hunting it was a long process but at the end we came to decide on a 1 year filing agreement with the court. I have been extremely careful but unfortunately today I was not paying attention and rolled a stop sign and was given a minor traffic violation ticket. I’m almost at the one year mark for my filing agreement and have not had any problems until now. I would love some input on whether or not this will affect my filing agreement deal.

Pursuant to Rule 11B of the Maine Rules of Unified Criminal Procedure and with the consent of the Defendant, this case is filed for a period of 1 year on the condition that the Defendant is not alleged to have engaged in criminal conduct during the filing period.


SPECIAL CONDITIONS:


Refrain from any criminal conduct.


Not violate any laws.


Make a donation to Maine Operation Game Thief of $500 by 12/31/2024.


Forfeit deer meat/carcass.”

Correct me if I am wrong but, based on your post, I am guessing that a "filing agreement" is some sort of deferred adjudication that gets the charges dismissed after 1 year of successfully complying with the probation requirements.

The penalties for night hunting are pretty severe and include jail time and fines.

"Not violate any laws" is disturbing. Without that phrase I think you would not have a problem since traffic violations are generally not considered crimes.

However, you did violate a law, albeit a small one.

The Maine statute on Probation doesn't appear to be of any help.

You would be wise to consult an attorney.

Thank you for the reply and I have already contacted my attorney the helped me get the filing agreement I have a meeting with him tomorrow just wanted some input on the situation as I’m hoping a small accident like this doesn’t bring back up something I thought I had felt with I have had a spotless record up until today with this stop sign violation.
