First/Last month's rent

What is the name of your state (only U.S. law)? California

I moved into a duplex about a year and a half ago. Because I work for the Police Department (easy to find if there is a problem), the landlord only asked for the first and last month's rent and no security deposit. Obviously, if there is any damage, I'm required to take care of it (not a problem). I've been told by a friend that the concept of "Last Month's Rent" is not valid in California any longer and that it was actually a security deposit that I paid. I'm planning on moving soon (nightmare landlord...she just called TWICE after 10 PM and also refuses to give me copies of the utility bills that she wants me to pay). Am I obligated to pay the last month's rent? I guess what I'm asking is, since the contract actually calls it "Last Month's Rent", can I hold the Landlord to that?

If the lease says its last month then thats what it is until then tell your friend who told you > I've been told by a friend that the concept of "Last Month's Rent" is not valid in California any longer and that it was actually a security deposit that I paid < to tell you the statute number, BTW you can search in your states LL/T part of its web page and attempt to find it your self. If the lease says its last month though thats what I would call it too If I was tenant and wouldnt be paying my last months rent making my LL prove otherwise if it was me.

If the landlord tries to state it isn't last month's rent, then take her to court for breach of contract.

Furthermore, put in writing that you want a copy of the utility bills and that you are not to be contacted after 8pm. Send this via CERTIFIED mail to her with receipt request. In other words, after she signs for it, they'll send you a post card stating the date/time she signed for your letter. This will prove you asked her for a copy of the bills and also will prove you asked her to call at a reasonable time.

Bill collectors have set times they can call (8am-8pm) and so do landlords.

Also there is a tenants rights group in CA you can contact. They are also available on facebook. It is called Tenants Together. I'd contact them as well. You can type in facebook "tenants together" to see their profile as well as the website (which is the same as their name).

I wish I was as lucky. We don't have one in my state. I am however going to a legislature meeting on Friday about putting one together after my scum slum lord has tried to screw me over.
