First time offender

What is the name of your state? Florida
My son was caught with less than 20 grams of pot. He was parked at a park. The officer gave him a notice to appear and was not arrested. We were allowed to pick him up at the park. He has no prior record and has never been in any trouble before. The officer commented on how polite, honest and respectful he was. Do we need to retain a lawyer and what are his chances of jail time. He is 21. Thanks for any info as we are unfamiliar with what to do or expect.

He's an adult, for Christ's sake!!

When are you going to cut the umbilical cord, and let him suffer his own expenses and consequences?

Do you actually believe this is his first experience with drugs? By helping him, you are making him co-dependent, and he'll never learn a thing.

:p i just thought i would tell you mister liable or whoever the guy that posted before me never gives you an answer. he only puts down you. no matter who you are and insults you. i came to this site looking for advice and i am sure you did to. so hold out i have to believe that someone more intelligent than that first grader will reply...good luck!!

Thanks, topconfused. I checked Mr. IAAL 's other posts and was not offended for his useless comments due to the fact that most of his other posts were also useless. Hope someone out there can give me some useful advice.

What are you talking about? Everything IAAL says is correct, and he just offered you a valuable life lesson regarding the "raising" of your son. If that's not helpful advice, I don't know what is. and IAAL has yet to insult me, so I don't know about that "no matter who you are" bit.

Anyways, this might be what you're looking for: as a first time offender, he will most likely be offered deferred prosecution which is a fake probation, and an attorney is completely unnecessary.

If I wanted advice about raising my son I would have gone to a different forum. I came here because I have never been arrested and neither has my son. I am not so stupid as to think he has never smoked before. None of this was the issue at hand. I just wanted advice as to whether I needed to retain a lawyer or not. Thankfully I found someone who could truly help me with my situation so I will not be using this forum again for this matter or for any other matters that may occur in the future. Thanks for nothing.

I just thought I'd let you know who you were "thanking". You see, topconfused is a drug pusher, waiting to go on trial herself. This is the type of person who poisons YOUR son, and costs you money.

topconfused is the type of person who will be on your side. That's the type of person you're destined to see more of because of your son.

Remember, you are the company that you keep, and "thanking" topconfused makes me wonder about you.

But, you can dislike me all you want. I'm successful, and have common sense. Paying the defense costs of an adult 21 year old, is not my idea of common sense.

So I guess if you had a son in this very same situation you'd have cut the umbilical cord and let him suffer the consequences with no help from you, right? People make mistakes and hopefully his son will learn from this. By the way I didn't see anywhere that dp1220 was paying his sons legal costs.

I only thanked topconfused for the way he responded to me. When I wrote "thankfully I found someone to help me" I was not referring to him but to someone outside this forum. As far as payment for my son's legal fees, he is paying for it. Just like I made him pay for his own car, and car insurance, as if this is your business or as if it even mattered to what I was inquiring about. And by the way if he weren't going to school and holding down a job, I would have him pay rent at home also. I was brought up with the idea that I could always count on my family for love, support and advice. I am doing the same for my children so that they will do the same for each other and the families they will create in the future. Thanks to all in this forum who tried to be helpful.

Thanks Jared. We did retain a lawyer and will be meeting with him on Sat. I have already spoke with my son about not smoking or even being around it and that if he screws up it will be jail time. I told him to look at this as a wake up call. He realized that if he does jail time it means losing his job, girlfriend, not being with family and that it's not worth it. Even though we have discussed much of what you wrote, I will show him your letter because I think it will help him 1) to hear from someone who has been there and 2} will reinforce the things we have talked about. Thanks again.
