What is the name of your state (only U.S. law)?

Hi my name is Anuj, today i.e 10/18/2015 morning around 9 am, i got a citation ticket for speeding for 88 mph on 55 mph. The Officer asked me to come court on or before 11/16/2015. What should i do to ward off the citation or at least mitigate the consequences of this citation (Penalty & history on DL). I request here to one and all to please help me out as I am a student.

A foolish student at that. Bet it felt good speeding down the road like that. Now you get to pay for it.

I don't see where you have any defense. Wherever you are the judge will believe the officer and you'll get the fine and points on your record.

Sometimes a strategy of pleading not guilty will get you a plea bargain where either the fine is reduced or the citation is reduced to something less serious.

You could try that.

Or, you could give a lawyer $1500 and see how that goes.

Either way, a dismissal is almost guaranteed not to happen.

The reason for Blue Meanie's statement is that we handle US law questions and legal concerns only, and we ask for the state name of all posters to this site because the laws in each state vary in significant ways.

Is this current speeding ticket the only driving violation you have had, in Texas or elsewhere?

As was pointed out by Quincy, the laws of various states matter. Blue Meanie was simply quoting the statement that the forum makes as a way of urging the OP to post his/her state. Your response (without knowing the state) was a guess - a guess that, depending on the state, could have been wrong just as easily as it could have been right. Of course, this is moot, since the OP has posted Texas as his/her state. I'm only posting this as information for you so that you understand why the seniors respond the way they do.

The Texas Department of Public Safety states that "A driver license will automatically be suspended if an individual is convicted of: 1. Four or more moving traffic violations within a 12-month period, or 2. Seven or more moving traffic violations within a 24-month period."

The amount of your fine depends on the county is which you were cited but the number of points on your license will be the same regardless of county. These are determined at the state-level.

The above-quoted information is incorrect. It is possible in Texas to get a speeding ticket dismissed by passing a driver safety course. Based on what Anuj has disclosed, however, it is impossible to tell if Anuj is eligible.

It could be possible to mitigate the consequences somewhat but, under what you describe, there are no guarantees. It might help for you to speak with an attorney in your area to see if there is any way to question, and reduce, the 88 mph reading or otherwise challenge the ticket.

If you can get the 88 reduced to at least 80, then you could be eligible for a dismissal of the ticket by enrolling in and completing a defensive driving and traffic school course. I believe (but you would want to verify) that dismissals are available to those whose speed has not exceeded the posted limit by over 25 mph (although other conditions may apply). If the ticket can be dismissed, this in turn will remove the points from your driving record.

It can also be possible for a court to offer a deferred adjudication in exchange for a guilty plea. A conviction will not be entered. You will be placed on probation and you must meet all of the terms of probation during your probationary period. If all terms are satisfied, your offense will be discharged and dismissed.

For fines, there is an "indigency" reduction for qualified individuals.

We have some forum members who are not only better-versed in traffic laws than I am, there are a few who might be able to provide you with some direction on how you could potentially fight the traffic ticket. No advice offered on this site, however, should be relied on in place of the advice you get from an attorney who is licensed to practice in your own jurisdiction.
