Well if everyone would do that then there wouldn't be a problem. This whole issue had arised from I do believe a tenant complaining not an owner.

**A: it makes no difference since in a HOA, a tenant has the same rights as an owner in expecting House Rules and provisions to be adhered to with respect to the noise and flooring issue.

Since there is nothing in the by-laws pretaining to this issue, they cannot pass this without amending the Bu-laws with a clause giving the HOA rights to make decision on Decor for all units, not just second floor?
I live in a second floor unit and I can honeslty say that I can hear my 1st floor neighbor loud and clear, so why should second floor units be singled out?? Just asking...
