I live in the state of California. I lived with my boyfriend and we are both on the lease. During an arguement he threatened my family if I didn't leave. Believing he was just angry and we would work things out I went ahead and left taking clothing and some of my sewing items. He then changed the locks and refuses to let me in even to get my belongings. I've been staying with my mother, believing still that he and I would work things out. My mother lives in a senior mobile home park and I can no longer stay with her. This has left me homeless. I want to reenter the home so that I may find suitable housing for myself. Do I have any right to do so. I've spoken with my landlord and she has told me that I have every right to live in the house because I am still on the lease. The police say they will arrest me if I have a key made and reenter. What do I do?

We need the entire story...

You LL is correct in saying you are allowed to enter the aparmtent even if your BF does not want you there as you are on the lease.

How did the police become involved? If they say you will be arrested if you make a key and renter, then you must abide by their rules. Did your BF get an order of protection against you?

Something missing here....

If the police were involved they would first of ask if you live there unless there is some kind of restraining order they would not arrest you for entering the unit if it is your home.

Does your mail get sent there?
Is there a restraining order?

Post anything you are leaving out you cannot expect a good answer if you leave important points out.

he threw me out...I returned to get some things...a window in the door was broken in the process of me trying to get in and him trying to keep me out....at that time there was a no contact order issued which was dropped after going to court. My landlady has told me I have every right to live in the house but he still refuses to let me back in. The police were involved because I asked them for advice but they also stated that they are not attorneys. An attorney told me if on the lease I can move everything I own out of the house for as long as I like and as long as I'm on the lease move it back in at any time. I did tell the police that and they said the attorney was wrong, but they also stated that they are not attorneys( try and figure the logic on that one). Some mail still arrives there but he had been opening it or throwing it away so I changed my mailing address. I want to do the right thing here. I want to know what my legal rights are. I don't want to break the law but I'm tired of being bullied and pushed around by this guy. I love the house and took care of the property which he has let go to ruin. I don't think it right that because he's a control freak that I should be homeless. I'm just at a loss as to what to do.
