But he should be thrashed soundly for hijacking....

Gosh, I cannot believe that I said that, now that I recall I remember you said something about getting out now before it is too late. Yes I indeed quit on Saturday, the next day after the robbery,I went in and seen to write up notices and refused to sign them for they were bogus statements. I am so sorry that I stated I still worked for the company. I am going to go and reread my statements. So off to the unemployment office I should go? Does it matter how long I was employed there?

I can't recall off hand whether in your state the length of time with your last employer counts if you've fulfilled the base period. But you have absolutely nothing to lose by applying. The worst thing that can happen is that you get declined for UI benefits, and if that happens, you're no worse off than you are now. There's no penalty for guessing wrong or for applying when you don't qualify.

Yes, you should go to the unemployment office. Be sure to tell them about the sexual harassment you experienced and the fact that your internal complaint was never investigated and you experienced retaliation after you complained.

Yes, it will matter how long you were employed there or how many weeks you've worked in total (for all employers) in the last four quarters but I don't know what your State's requirements are on that. Let the State figure it out. You have nothing to lose by applying for unemployment benefits.

Good for you for quitting. I realize that means you now have some financial challenges but you're still a lot better off in my opinion.

boonehead, you should probably change your name to bonehead if you really think OJ was innocent. Just a joke, I know you were being sarcastic. However, that was not an interpertation of the facts in my opinion. That was ther cops getting caught framing a guilty man.

Guess what!!!
I had the face off with my GM and I was so calm and smooth, I scared myself. He brought up the felony charge, and I felt as if the stool was kick out from underneath me, yet I hung in there. Admitted that yes, I do have a past, but it has NOTHING to do with this or my future and I even understood why he would have to let me go. If, as he said Company Policy.

But, Before I gave in...I demanded him to explain what ZERO TOLERANCE means, and he got all confused and began to studder and I was still not getting the answer to my question.
I then asked him to put in writing what ZERO tolerance means. He shoved the paper away and said he "ain't putting nothing on paper."
I then asked him if I signed an arbitration agreement and he did not even know what that meant. So I then asked him if he knew if I was eligble for unemployment...he did not know.
I dismissed my self from the table after he said I was not getting the answers I wanted to hear....I almost began to cry, put I don't like to appear soft. So I told him, that I am doing nothing his wife or daughter would not do by complaining and walked out.

Did not even make it home, and he had called me twice. I had asked him before things got heated to mail me my check, he wanted to know if I still wanted him to do that for me.
I had already stopped and got it, I FINALLY realize that even though I did feel guilty for the unwanted advancements...(I stopped wearing makeup and doing my hair, thinking that would help.) I have nothing to be ashamed of. I held my breath, walked in the door and got in and out with my check.

I now got a call by the GM asking me if I wanted to get transferred to another location....I told him I wanted my old store back, he said he would call me back and he did today and told me my manager was fired, don't know about the assistant manager, and transferred me to a new location. I accepted.

What do you think about that? Am I being set up for a bigger fall?
Am I eligable for my week's worth of loss wages? I guess it was company policy to have the manager present when recieving a write up, she left it fully disclosed on her desk, not to mention all the paper work I HAD to sign to get in, was suppost to have been gone over with me by my manager, and my manager just told me to take it home, I totally forgot all about it and had to be reminded to bring it back signed. He pointed out more errors on her part then I ever knew were wrong.

Could you tell me if Beth will get this message? She knows this case, and before I do return back to work, I want to ask if it is the best place to return. Or are they playing nice because they were wrong.

Also, you maybe able to address a few concerns/question if you would be so kind.

What is Zero Tolerance mean? I realize what 3 strike are.
Also when filing a grievence is that is something that is placed on a form or just scibbled on a pad of paper? I thought the process would have been more formal. I want my side documented. I thought I would get a copy and so would everybody involved. Because even my accuers deserve to tell their side too. Yet, I am not sure if anybody will know except the GM. He never informed the Manager above him.

Beth will get the message but not necessarily before Monday. Like most of us she is a volunteer here, doing this on her own time, and while she often checks in once or twice on a weekend that's variable depending on what she's got going on in her personal life. I've noticed she frequently checks in SUnday mornings. But she'll see it Monday if not before.

Zero tolerance GENERALLY means that action is taken on the first offense. What kind of action is taken can vary.

Filing a grievance can mean anything from scribbling a note on a piece of scrap paper to completing a four page, detailed pre-printed form, and everything in between. It depends on the company, the union (if applicable) and the situation.

Beth has really been a big help to me.

I recall seeing the company policy that states there is a zero tolerance in any type of SH, this was after I made the complaint, and it was then I thought perhaps had the GM done his job I would not have had to put up with the harassment. Because it became very clear they all knew who had complained.

I am not looking to sue anybody, I am just not sure if I am stepping in to a web which could result to allegations against me. NOBODY wants to loose their job. I just fear that perhaps I am getting back into a mess that I might not be able to get out of.

Being transferred is something I requested I did not want. I wanted to go back to where I started, and allow the others to be removed or transferred.
Now that the GM won't transfer me, makes me think that he is still trying to protect himself and the others. There was never an investment in the SH, he just told my manager who then told the assist. manager (both of them are related)
No matter what is happening this GM is still not punishing the man that made the SH, along with drinking on the job and theft. Although the manager was fired (so the GM says, which he says is just between him and me) for other issues, which are too many to list.
I think that the GM is trying to keep me quiet because he never took me serious, not to mention a few past employees that I know called for help too. Therefore, he has no documentaion for taking this entire mess and doing something about it, until I refused to walk away.
When I called the GM's boss, it was only then did the GM begin to take me serious. Since I did not run out ashamed of my past, and stuck to the facts is when he gave me a job back. Yet, he had told me a day before that people with past conviction are not allowed to work for the company.
What do I do? Go back to work at a different station, or collect unemployment until I find a new job, or work at the station until I can get my store up and running?
I need a second income to compensate the traffic of a new business that has not been advertised....about 2=3 months.

Can you add a spell checker to this forum, for the people who cannot spell.....like me? :D
