Does the legal owner of a property need to be notified if the said property is going to be foreclosed due to the taxes not being paid? The owner had no knowledge that they wasn't being paid as he's incarcerated and his uncle was living in the property with the understanding that he would take care of this.

Now landbank have foreclosed due to non payment of the taxes but they didn't contact the owner, they just sent letters to the property. Is this legal? Should they (landbank) have notified the owner by way of a letter to the Facility where he is incarcerated?

The entity registered as being liable for the taxes I.e. The person that is listed with the local assessor office will be sent a registered letter at the address provided to the tax office (after a bunch of other notifications) of the impending foreclosure. There will also me a notice sent to "occupant" at the address of the property in question.

They tax office is not responsible for searching the title history to ensure the person listed as the responsible party on the tax rolls is an owner or the owner.

At best the owner may have a cause of action against the uncle but the state is not obligated to ensure the legal owner is given notice other than by the means listed
