What is the name of your state? Ohio

An unexpected financial hardship has caused us to be late one month, then paying the maximum we could afford for the next 6 months, sometimes equally more than a whole month's payment, sometimes a little less.

We tried NUMEROUS times to speak with the mortgage company (not a bank) and make some sort of arrangement to get on track, however they are so big and although we were told one thing (and that it was being typed in to "our account notes") the next person we spoke with said "nothing shows of any conversation with you". Never once have we been able to speak with the same person twice.

Monday we were served with foreclosure summons, 28 days to respond to their attorney. What are ALL are options? Can we try to sell our home quickly, if it happens once on the market?

Thank you for the advice. We have never been through or heard about this process and appreciate any advice.

are you behind on the mortgage now? How far behind? What was the payment plan you made? Did you keep it?

We are now a total of almost 2 1/2 payments behind plus late fees.

We were never able to make an established payment plan other than our original mortgage.

Pymts due are 867/mo. When we first fell behind (in Oct. 2005) we were one month past due and were told SPECIFICALLY AND CLEARLY they would not accept ANY payments except exact amounts, no partial payments split between our 2 pycks per month. So we were under the impression we couldn't send them a little extra to catch up the one month.

Then in April 2006, another of their representatives told my husband that person lied. The company would never refuse money, just couldn't change the dollar amount if paying on their website online from anything but the 867.00. If we were to send checks or pay via our online banking, they wouldn't refuse it. THAT was totally different from what we were clearly told in October.

Well, in March my husband was demoted at work and our income dropped, while going through that, I had medical issues so bad we were faced with medical costs up front, tons of extra gas (trips to ER and specialists), and co-pays & Rx's. It threw us into even further behind. Paying only $400 one month, $300 another, $600 another, then paying $900 and $1,000 other months trying to catch up again. We told them about all the issues in writing and on the phone, yet they STILL didn't have it "in their system" as anyone ever talking to us about it! :mad:

Please, would someone tell us the best options to take at this point. Should we just consult an attorney or is there steps we can/should take ourselves. We have no idea how this all works, or what to do.

EMC (The mortgage company) is STILL calling the house everyday, up to 12 times a day. (Their automated computer system, no live persons)

It's been one week since we received the summons, and have been getting mail daily from places claiming, "We can help you stay out of foreclosure". I've chucked all but one just to keep for reference, as we both assume they are scams.
