Found Father After 18 Years! HELP!*
What is the name of your state (only U.S. law)? Pennsylvania/New Jersey

My father left my mom about 6 months after my birth and hasn't provided anything since, not even a location or perhaps a number to reach him by. Lost for the past 18 years my mother found out information about him. Using this i called him the day before i graduated high school and asked him if he knew my mom and declined, but never the less answered a few questions about him self that proved he was no doubt the man my mom once knew. i would just like to know the following and any advice is welcome PLEASE!

How can i go through the courts and what can i do to have him tested and prove he is my dad?

Could i sue him for not providing for me or giving anything to my mom or possibly something for emotional childhood dreprevation of not having a father through out my life?

im no legal expert but im just trying to conjure some things up that i can get him for since he screwed me AND my brother over who is 17 years of age. doube whammy huh? :\

No, you are an adult now, and you cannot compel this man to submit to any testing. Your mother should have done that many years ago.

You cannot sue this man ~ he owes you nothing. If paternity was legally established then if there were orders for support he may owe your mother.

Your mother can certainly establish paternity for your younger brother and then if he is not not over the age of majority she can request child support from the time she has filed going forward.

yeahh but he evaded child support for 18 years of my life so couldn't my mom sue him for something?

Just to make this abundantly and plainly clear.....You want to make a man you just contacted take a DNA test to see if he is your biological father for the sole purpose of suing him for child support???

You actually said sure him, not sue so its anyone guess....

Wow, just wow....

But anyway back to legalities....go get a lawyer b/c this is just way too complicated a situation and I do not see how you will be getting anything from this man...even if he is adjudicated the father of you and your brother.

I have not seen my father since I was 9, so should I go and sue him for the child support he should have been paying all this time??

You do understand how absolutely and utterly ridiculous this looks right?

not if your mom never pressed the issue in the past. She could have gotten an order for child support years ago and even if he stayed hidden they would have had ways of finding him. If nothing else, she would have an order that she could enforce now that he is found. She cannot go back and ask for it now that you are an adult.
She can ask for child support on your brother since he is a minor- but she will only get it from the date she files asking for it til the date he reaches majority

So was there a court order for child support? You cant have a child support order without paternity being established legally at some point so which is it?. It doesn't matter, your mom let that ship sail long ago and she should have filed contempt or did something years.

And why are you looking for this money anyway? Why NOW all of a sudden are you and mom SUPPOSEDLY looking for a way to "get money" out of dad NOW?

oh okay thanks. well they did try to find him and they didn't so thats the whole point..... they couldn't..

nooo i was just thinking of situations that could be involved in the matter because i don"t know what i can do. and my mom doesn"t need money you a$$hole, it"s just im trying to see if that could be the possiblility and she tried to file things but he was never found because from the records i checked he like unconditionally moved to florida... :/ can you guys just give advice and not ur ****ty opinions on the matter?

Why do it now? Just to get money? Is it REALLY that important? The money that is?

Why would you want to try to bring someone back into your life who doesn't want to be? Revenge?

You obviously have anger issues and need counseling .

BTW I DID have a dna test after twenty something years. It wasn't for money or revenge though and all were willing. You have your own issues to work out . Get help for yourself.

Possibly not...if the AOP was signed at the hospital then legally he is his father.

If he was already gone before the third trimester, HOW could he have signed an AOP at the hospital?

I assume they were NOT married? Was the AOP signed, birth certificate, DNA test??

With this statement I have to assume that there was not AOP signed, no DNA - nothing. Therefore, if he was not married to your mother, then he is not your legal father.

That's a key word "conjure" - you are trying to find anyway you can to "get him" - sorry...not gonna happen. If your mother did not follow up with the proper paperwork and court filings to have him l egally declared as a father and did not file for support - she and you are not entitled to a thing - not ONE thing!
