This is the situation:
A individual I am now aware of who was on temp status and did not have a visa to work in the United States, presented himself to a sailing company as a sub-contractor sailing instructor.
He filled out a qualifications questionnaire where one of the questions asked: “Are you allowed to work in the US” he answered yes.
The company sub contracted him from time to time when the need was present, for this individual indicated that he was allowed to work in the US, he had a SS# and a state issued Drivers License and besides, he wasn’t being hired as an employee, but rater a sub-contractor.
Anyways during a sailing lesson (teaching a client of the company) this individual began relations with one of the students, eventually getting this student to marry him (with in 3 weeks of first encounter). From what I understand this individual is highly manipulative so this scenario didn’t strike me as sounding too odd. Shortly after being married he let several individuals know that “no one can touch him now”.
Is this true?
The word is they do have a baby on the way.
Is he deportable since the circumstances for his first encounter towards marriage never should have legally existed in the first place?
Doesn’t the INS place importance on “Good Moral Character”?
And if so how could someone of good moral character proceed forward defrauding a company to obtain employment?
Another situation here is that as of recent this individual has now started his own sailing business that he put in his wife’s name and is now competing with the previous company. One again how does someone of good moral character do this?
The three biggies here are:
Is this individual deportable given the above circumstances?
If so what are the next steps to begin the process?
If not –will someone please bring me up to speed as of why and perhaps follow up with a suggestion of what can be done.
