Fraudulent.. Bill of sale.

Hello I need advise. my trailer was issued a new title this year. Im just find out that its under someone else's name The trailer was involved in a accident. And the tow company ask if it was my trailer i told her yes. She stated it was coming back to another person. So i go home find my title and send it a copy to the insurance company. They tell me its listed to someone else. So today i go to the dmv and they ssid the person repented a Bill of sale and took a bond out on it. So it his trailer. I need to know how to dispute this. I have always own the trailer and have always had insurance on it. How can can person just go with a bill of sale and get a title. Please help. I pissed and i dont know what to do... thanks

No, they can't just go with a bill of sale and they didn't they also put up a bond as you mentioned.

You are going to need a court order.

It seems remarkable that that this dispute cannot be resolved between the effected parties, the respective sellers of the unit, DMV and the manufacturer of the trailer. Depending upon the aggressive nature of the department that might force the insurance company to justify their rejection of the claim by disproving your documented claim of ownership.

Another option would be to seek satisfaction from your seller.

The last resort would be to file an action for a declaratory judgment joining as defendants the adverse claimant and your insurance company. In which case should you prevail there is a likelihood that the insurance carrier could be held responsible for your attorney fees.

Go to the dmv and ask them how to file a claim on the bond. Then once you are paid out the value of the trailer (pre accident) ask if you can have the “owners” address so you can tell him to pick up his trailer.

I don't know if it's possible, but if you can get a copy of the bill of sale it should have the name and signature of the person who sold it, then you may have legal recourse for fraud/forgery.

While it may be possible for the individuals can work it out for themselves in doing so the guy that took out the bond would be admitting he committed fraud. And TX DMV clearly states how to handle this.

Why contact consumer complaints? The OP didn't say it was a business that did this.

Couldn't this just be a simple error? Obviously the trailer has been in the OP's possession and not in the possession of the person who got the bond. Obviously the person who got the bond wasn't trying to take the trailer away from the OP. Maybe someone, either the person or entity that sold "a" trailer to the new person or the DMV, accidentally used the serial number for the OP's trailer as the serial number for the other guy's trailer?

Not a bad thought.

The bonded title should have a manufacturer and maybe some description of the trailer. If that doesn’t match up with the ops trailer, something such as this may have happened.
