Can the Fresh & Easy grocery stores legally tow your vehicle for parking a regular, fuel powered, automobile in one of their "Hybrid Parking Only" parking spotts? Such a notion seems to fuel questions like, are they saying that hybrid owners are less able to walk, or are they telling me that I have to park further away from the enterance because I can't afford a hybrid...

It may be discrimination, but it's not illegal discrimination.

This is private property, and you are invited to go there, similarly to inviting your friends over for dinner. If a dinner guest demands to be seated at the head of the table, you are free to 'uninvite' him from your home, and call the police to have him removed.

According to local law enforcement, not even a stop sign placed on private property (ie: as found in a mall parking lot) can be enforced by police. I understand there are certain laws which protect a person in their own home. However, your analogy doesn't make sense. I have never gone through a parking lot and placed an advertisement on thousands of random vehicles inviting people to my house. I'm pretty sure that places of public business (which advertize to or "invite" the generl public), whether they be on public or private property, do not have the same legal discrimination rights as private citizens do regarding their place of residence. I understand that they can post any signs they wish. However, the ability to legally enforce them, and cause me the expense of having my vehicle towed, is a different matter. Just because it is private property doesn't mean they can just do whatever they will with my personal vehicle. Since you want to compare this public market to a personal residence, by your logic I should be able to post a "no trespassing" sign on my door and then shoot whomever I should decide is uninvited.

Along with that; who said the police were involved? You asked if the Fresh and Easy market could tow your car.

if you do it to prevent their entry, you can in many states. Once you allow them in, you have moved them from possible trespassers to invitees or guests.

and to be real picky about it; In Colorado, you can do it pretty much as you are inferring.

What state are you in?

In general, this would be legal discrimination. The store can also have parking only for preferred customers and even customers of the month. They can then generally tow cars off of their lot at their own expense and liability.

Was there a sign at the driveway indicating that the lot was for customers only? Warning against parking in special places? Something else?

In any event, if you believe that you have a claim against the store, you can file in small claims court for the cost of the tow.

Disregard the entire subject.

My vehicle has not been towed off of a Fresh & Easy parking lot. I just felt that those signs were unlawful discrimination, and was hoping to get it clear. I did receive some good and useful information. I always park my big, American made, gas powered pick-up in the hybrid spots every time I go to Fresh & Easy. I was just daring them to try and have it towed. Thanks to everyone for your enlightenment. That is, everyone except "JUSTALAYMAN".

Clearly they want to give preferential parking to those who are being proactive about conserving energy and the environment. It is no different than Babies R Us having special parking spots outside for moms-to-be (which is their target demographic, by the way). Would you park there, too?
