What is the name of your state? GA
I have 2 months left of a student loan garnishment. Got an email from my HR/payroll informing me that they will be collecting a $25 per paycheck (every 2 weeks) "administrative processing fee" beginning 5-11.
OCGA 18-4-97 says:
The garnishee shall be entitled to his actual reasonable expenses, including attorney's fees, in making a true answer of garnishment...may deduct $25 or 10% of amount paid into court,...not to exceed $50, as reasonable attorney's fees or expenses."
My questions:
1.Who is this money going to? Because I doubt my HR department has incurred any attorney's fees pertinent to my garnishment. Who is the garnishee, is that the CA?
2.Since, as usual, this wording is so nonspecific, HOW MANY TIMES is this allowed to be deducted? Per paycheck? One-time only? Because it sure sounds like a one-time fee to me. Not that what it implies, or sounds like, has any relevance.
3.Can I dispute or argue this? What if they only spent $20 on fees? It's got to be negligible in a garnishment proceeding. It does say "actual." How do I know what's "actual." Just whatever the CA says it is?
