Getting hang-up calls from Bass & Associates

I'm getting hangup calls from Bass & Associates. Gotta love caller I.D. I filed BK and was discharged 3/2004. I did a search here and noticed they are a collector for Best Buy. I was wondering if anyone else w/a BK is getting calls from these people and what possibly would they want from someone who has been discharged from their BK? I did have a BB account that was discharged, but didn't purchase anything that they would want returned.

I got an email from Bass & Associates recently about a laptop I purchased at Best Buy a while back. I declared BK and it was discharged and they say they want the laptop back?? I've never heard of this happening. I got rid of the laptop long ago. What can they do about this?

Not much at all !! You can't give back what you don't have and if the laptop is more than 2 years old, its worth diddly squat.

B&A are in the business of harrassing people to give back purchases from BestBuy (and a few others). It doesn't matter what you bought or how long ago it was, they will keep annoying you in the hopes you'll PAY them to make them go away. While it may happen, on 4 different boards over 3 years I've yet to hear of a SINGLE case where these scumbags actually filed a Replevin action to recover merchandise purchased at BestBuy.

As I said before, unless you bought a honking huge wide screen Hi-Def TV, its not WORTH it to them in 99% of the cases to shell out $$$ to take back worthless USED merchandise.
 
I finally got tired of the hangup calls from B&A and decided to speak to them directly.

The lady from B&A said that since my BK has been discharged they want to know what my 'intentions' are. I'm not sure what she means by 'intentions'. Either pay them or return the merchandise???? I really don't understand. I asked her if she had spoken to my attorney and she said that she did and my attorney didn't know what my 'intentions' were.

She said that there is a 96 dollar charge for something I bought at Best Buy that they are interested in getting back. I told her I probably don't have the item anymore and she said she would find out what I purchased and call me back. I really don't understand why they are calling me for a 96 dollar item.

What should I tell her when she calls back? I know they can't demand money on a discharged debt. What happens when I tell her the property they want is no longer in my hands and was sold or given as gift?

Like I said before, it is very unlikely they will pay the cost of filing for replevin for a lousy $96 item, not when the filing fees and court costs will be a LOT higher. They are HOPING that you will cave in and throw money at them to make them go away. Turn off the ringer on your phone if you have to or change your phone number but stop talking to these people. As to your 'intentions'.. they want to know if you're a) going to GIVE them the merchandise back b) GIVE them money to keep the stuff or c) (my choice) tell them to take a flying leap.

They do NOT want this stuff back ! Best Buy can NOT resell this old stuff and even if you DID pay $96 for some BB item, IF they sold it at some auction, they'd NEVER get anything close to $96 for it !!

I would continue to IGNORE THEM. The REMOTE possibility that they'll go as far as a Replevin action in your local court is just too remote - not for that small an item. If you had an item that was THOUSANDS of $$ they probably would go that far, but that isn't the case.

If you don't have the item, you don't have it. They cannot force you to give them any further information and they can't force you to pay because the debt was discharged. If you want to tell them to get lost, tell them you sold the stuff long ago for money to pay rent and buy groceries and then hang up !!

That's me :D !!! When it comes to scumbag debt collectors and the likes of B&A, I don't pull any punches, you have to be just as hardnosed as they are and just NOT budge. They are used to getting their way, used to intimidating people into doing something they do NOT have to do. Like any bully, if you stand up to them , they'll stop bothering you -eventually.

IF, BIG IF, they file for Replevin, THEN you could offer them 25% for their $96 item..that's about all they'd get at an auction anyway - if that !
 
Can I send them a cease and desist letter at this point? If so, does it have to be in 'lawyer' terms or just a simple letter stating not to call me anymore?

I sure would send them a C&D. It doesn't need to be complicated, just tell them to stop harrassing you, the debt was discharged.
