getting screwed by my lawyer

I was in a car accident involving me riding with my friend and he lost control and we flipped many time and have gone through months of physicaltherapy,months onf cognitive retraining. i just found out that i am going to have back surgery (disc replacement). i have 50,000 in medical bills and the surgery is going to cost 60,000 and the other persons insurance has only a 100,000 dollar policy. my lawyer just told me today that all i can get is 100,000. i will have well over 100,000 in medical bills when its over with. i already know about my underinsured coverage and it still not going to fully compensate me at all. i cant sue my friend because he is only 20 and doesnt really have anything (money). what are my options for getting more money. forgot to mention that i have a traumatic brain injury. If i decided to go with a different lawyer how much would i owe my exsisting lawyer. Any answers would be appreciated. thanks

:rolleyes: Your attorney is just telling you the facts..You reach the limit of your friends ins. at $100,000...You have other options that you have stated...You could go after your friends future earnings, assets.. Attorneys seek 1/3rd of a settlement..:cool:

while i only sympathize with your plight..once again we have blame aimed at the attorneys of this world. it not your attorney's fault you had little SUM or underinsured..not his fault the other driver carried a 100/300..and not his fault you sustained injury. While your injury is worth much more if your brief synapsis of facts are truly reflective of your objective medical condition... im afraid the only people you have to blame is the tortfeasor, yourself and maybe your insurance agent who is neither obligated nor inclined to tell you that supplementary coverage is cheap and necessary. Your attorney may have waited to tell you because he may have just received your declarations page which advised him of such limits..or alternatively, he just received the tortfeasors limits which would have advised him as to whether the SUM coverage applied..
Should you wish to change lawyers, they will apportion as between them with the remaining 66 2/3 percent of the net proceeds being disbursed to you... that means you will in all likelihood walk away with little to nothing if your lawyer has any liens on your case from major medical or medicaid or your treating physicians..unless you do not feel confident in your lawyers abilities, i will let you know that any neophite can settle a clear policy case..changing lawyers may only cause delay and additional time for lienholders to place your attorney on notice of a lien..this may not be so advisable (wink wink)... you may want to up your PIP (No-Fault) coverage for the future.. Do us lawyers a favor and dont blame us.. the media and the president seems to be doing a great job without you.

You may want to work on your spelling, grammar, punctuation, and sentence construction then. Wouldn't want NYU to get a bad rep now, would we? (Whoops, too late!)

in your original post, you stated you KNOW about your underinsured coverage.....so just ask your attorney for more information!!!
